Attached is the Revised Order of Business for the Regular Board Meeting of November 12, 2013.  The Order of Business was revised to include revised language for Tab 41, Resolution on Common Core Technology Project, and adding Tab 43, Common Core Technology Plan: Phase II and Beyond, Old Business for Action.

Is this legal?

The Brown Act requires a local agency


· To post notice and an agenda at least 72 hours in advance of any regular meeting (§ 54954.2(a)


The Brown Act includes weekends and holidays when computing the 72-hour requirement of section 54954.2.  The language of that section provides that “[a]t least 72 hours before a regular meeting, the legislative body of the local agency, or its designee, shall post an agenda containing a brief general description of each item of business to be transacted or discussed at the meeting including items to be discussed in closed session.”  Nothing in that section or other sections of the Brown Act indicate that holidays or weekends are excluded.

 


2cents smf: While this is apparently legal, the posting of these revisions at midnight of a holiday weekend demonstrates intentional minimal compliance, bad faith.and ethical turpitude.

  1. I think that what is disturbing is the stealth nature of Garcia's resolution: if Phase 2 is approved for her district, doesn't that imply that there will be inequities? Garcia should know that her district does not stand alone.

    However, what is worse is the notion that Tab 43 is an old business. What was presented at the November 5 meeting was not a request for approval of Phase 2 but the current status of the CCTP. Now Aquino is pretending that an approval of Phase 2 should be acted upon because of the many-hours dog-an-pony show put on November 5.

    Besides, Aquino's team did not ask then for authorization to continue with Phase 2. Now they are asking for such authorization even though the Board (or the public) has yet to receive any concrete information of what staff has "learned" from the not-yet-complete Phase 1. I am sure this will be news for Board Member Ratliff who is formally proposing that consideration on Phase 2 be delayed until June/July 2014.

    To me, that's an insult and borders on insubordination. But he is leaving, so he doesn't care.
